The Basics

What Is Primary Liability Insurance?

Primary liability insurance pays for injuries and property damage you cause to other people when your truck is at fault in an accident. It is called “primary” because it responds first — before any other liability policy — and it follows your truck while you are working under your operating authority or on dispatch, whether the trailer is loaded or empty.

Think of it as the foundation of your entire trucking insurance program. If your rig rear-ends a passenger car on the Turnpike, primary liability is what pays for the other driver’s medical bills and vehicle repairs, and it pays for the lawyers who defend you if the claim turns into a lawsuit. Without it, one bad day on the road could wipe out everything you have built.

One thing primary liability does not do: it does not fix your truck, replace your cargo, or cover your own injuries. Those risks need their own coverages, which is exactly why it pays to work with an agency that handles trucking insurance every day. Omega builds the full picture with you, piece by piece, so nothing important is left uncovered — and nothing unnecessary pads your premium.

Who It Is For

Who Needs Primary Liability Insurance?

If you move freight for hire under your own authority or on dispatch, primary liability is the policy your business runs on. These are the operations Omega quotes most often across New Jersey and the surrounding states.

  • Owner-operators running under their own MC/DOT authority
  • New motor carriers activating their operating authority for the first time
  • Small fleets adding trucks or drivers
  • Regional and long-haul for-hire carriers based in NJ, PA, CT, NC, SC, TX, or FL
  • Box truck and cargo van operators hauling freight for hire
  • Dump truck and construction material haulers
  • Auto haulers and car carriers
  • Intermodal and port drayage drivers working NJ terminals
  • Hotshot truckers pulling for-hire loads with pickups and gooseneck trailers
Inside the Policy

What Primary Liability Covers

Every carrier words its policy a little differently, but a primary liability policy is built around the same core protections. Here is what yours is doing for you the moment a claim comes in.

Bodily injury to others

Medical bills, lost wages, and related costs for people injured in an accident your truck causes.

Property damage to others

Repair or replacement of other vehicles, buildings, guardrails, and anything else your truck damages in an at-fault accident.

Legal defense

Attorney fees, court costs, and investigation expenses when you are sued over a covered accident — often the most underrated part of the policy.

Settlements and judgments

Amounts you are legally required to pay to injured parties, up to your policy limits.

On-dispatch operation, loaded or empty

Coverage applies while you are working under your authority or dispatch, not just when there is freight in the trailer.

Proof of coverage for regulators

Your policy is the basis for the insurance filings most for-hire carriers must keep on file to hold active operating authority. Omega helps submit them.

Certificates for brokers and shippers

The policy backs the certificates of insurance that brokers, shippers, and load boards require before they will tender you freight.

Know the Gaps

What It Excludes — and How to Fill the Gap

Primary liability is deliberately narrow: it protects other people from you. Everything it leaves out has a coverage of its own, and Omega can bundle them into one program so there are no surprises at claim time.

What’s excluded

These losses are not paid by a primary liability policy.

  • Damage to your own truck and trailer. That requires physical damage coverage (collision and comprehensive).
  • The cargo you haul. Freight is covered by motor truck cargo insurance, not primary liability.
  • Your own injuries. Drivers need occupational accident coverage or workers’ compensation for that.
  • Personal, off-dispatch driving. Driving the truck when you are not working generally falls to non-trucking liability (bobtail) coverage.
  • Premises, loading dock, and non-driving business risks. Those belong to trucking general liability.
  • Anything above your policy limits. A serious accident can exceed base limits — that is what a trucking umbrella policy is for.

Optional add-ons

Bolt these onto your primary policy to close the gaps that matter for your operation.

  • Motor truck cargo — protects the freight you are hauling against damage or theft.
  • Physical damage — covers your own tractor and trailer; usually required by lenders if the truck is financed.
  • Non-trucking liability (bobtail) — liability protection for personal use of the truck when you are off dispatch.
  • Trucking general liability — covers non-driving business risks like premises injuries and certain loading/unloading claims.
  • Trucking umbrella — adds an extra layer of liability limits on top of your primary policy for catastrophic claims.

Questions, Answered

Primary Liability Insurance FAQs

It pays for injuries and property damage you cause to other people when your truck is at fault in an accident while operating under your authority or on dispatch. That includes the other party’s medical bills, their vehicle repairs, and your legal defense if you are sued. It does not cover your own truck, your cargo, or your own injuries — those need separate coverages.

In most cases, yes. For-hire motor carriers generally must show proof of liability coverage before federal or state regulators will activate their operating authority, and that proof must stay on file to keep the authority active. Exact requirements and minimum limits vary by operation and cargo type. An Omega agent can confirm what applies to your business and help submit the filings.

There is no single price. Premiums vary based on your driving record, years of CDL experience, how long you have had authority, the cargo you haul, your operating radius, the limits you choose, and your loss history. The only way to find your real number is to compare quotes — Omega shops 15+ carriers so you can see your options side by side.

Primary liability covers accidents that happen while your truck is being operated on the road. Trucking general liability covers business risks away from driving — like a visitor injured at your yard, or certain claims tied to loading, unloading, and deliveries. Most motor carriers need both, and many brokers and shippers ask for proof of both before tendering freight.

No. Primary liability only pays for damage and injuries you cause to others. To protect your own tractor and trailer, you need physical damage coverage, which pays for collision, fire, theft, vandalism, and similar losses to your equipment. If your truck is financed, your lender will usually require physical damage coverage. Omega can quote both together so nothing falls through the cracks.

Primary liability applies while you are working — driving under dispatch or under your own authority, loaded or empty. Bobtail and non-trucking liability apply when you are not working, such as driving home after dropping a trailer. If you lease onto a motor carrier, their primary policy may cover you on dispatch, but you often still need non-trucking coverage for personal use.

Yes. Omega has specialized in trucking insurance for more than 25 years, and our team helps with DOT-related insurance filings so proof of your coverage reaches the right agencies and your authority stays in good standing. We also issue certificates of insurance for brokers, shippers, and load boards — usually the same kinds of documents you need before you can book your next load.
